This narrative about two boys from different backgrounds touches on family, forgiveness, sport, and making peace with tragedy. Dan Snyder was not a sure thing in professional hockey, but defied expectations—playing for both the minor league’s Chicago Wolves and the NHL’s Atlanta Thrashers. Dany Heatley, on the other hand, had been tapped for success from the start as a college star and high draft pick. The two made an unlikely pair, but became friends. In September of 2003, the then 22-year-old Heatley lost control of his speeding Ferrari; Snyder was thrown from the vehicle and died six days later. The loss of their teammate, friend, and son sent those who knew Snyder looking for healing or revenge. As the legal story unfolds, so too does a story of forgiveness, rooted in the Canadian Mennonite tradition from which Snyder hailed. Snyder’s family, taking an approach to their loss dictated by their faith, chose to make peace with both Heatley and his parents. This story of forgiveness reveals a lesson in loss, hope, and peace in the face of tragedy.
Liberal political justification is often accused of preaching to the converted: the values of such justification, it is claimed, are acceptable as values only to those already convinced by arguments in the secular, humanist Enlightenment tradition of political justification. This is the most taxing problem facing contemporary liberal theories of political justification. Catriona McKinnon suggests an interpretation of the ‘political constructivism’ approach to this problem offered by John Rawls. This interpretation argues that by placing the value of self-respect and its social conditions at the heart of the political constructivist approach to liberal justification, such justification can deliver on its promise to show why liberal principles of toleration and public reason are acceptable even to non-liberal people. A self-respect based constructivist approach to contemporary liberal justification restores to the liberal tradition the radical potential which it has always historically possessed.
In Between Facts and Norms Jurgen Habermas works out the legal and political implications of his Theory of Communicative Action (1981), bringing to fruition the project announced with his publication of The Structural Transformation of the Public Sphere in 1962. This new work is a major contribution to recent debates on the rule of law and the possibilities of democracy in postindustrial societies, but it is much more. The introduction by William Rehg succinctly captures the special nature of the work, noting that it offers a sweeping, sociologically informed conceptualization of law and basic rights, a normative account of the rule of law and the constitutional state, an attempt to bridge normative and empirical approaches to democracy, and an account of the social context required for democracy. Finally, the work frames and caps these arguments with a bold proposal for a new paradigm of law that goes beyond the dichotomies that have afflicted modern political theory from its inception and that still underlie current controversies between so- called liberals and civic republicans. The book includes a postscript written in 1994, which restates the argument in light of its initial reception, and two appendixes, which cover key developments that preceded the book.Habermas himself was actively involved in the translation, adapting the text as necessary to make it more accessible to English-speaking readers.
