Civil War officer, Reconstruction “carpetbagger,” best-selling novelist, and relentless champion of equal rights, Albion Tourgee battled his entire life for racial justice. Now, in this engaging biography, Mark Elliott offers an insightful portrait of a fearless lawyer, jurist, and writer, who fought for equality long after most Americans had abandoned the ideals of Reconstruction. Elliott provides a fascinating account of Tourgee’s life, from his childhood in the Western Reserve region of Ohio (then a hotbed of abolitionism), to his years as a North Carolina judge during Reconstruction, to his memorable role as lead plaintiff’s counsel in the landmark Supreme Court case Plessy v. Ferguson. Tourgee’s brief coined the phrase that justice should be “color-blind,” and his career was one long campaign to made good on that belief. A redoubtable lawyer and an accomplished jurist, Tourgee wrote fifteen political novels, eight books of historical and social criticism, and several hundred newspaper and magazine articles that all told represent a mountain of dissent against the prevailing tide of racial oppression.
`The author has provided us with a masterful overview and critique of liberal theorizing of the past quarter-century. While dealing exhaustively and fairly with each of a variety of broadly liberal approaches, Gaus also presents a compelling argument for his own preferred “justificatory” approach. His analyses range across familiar territory – Berlin, Gauthier, Baier, Habermas, social choice theory, Rawls, and so on – and are always illuminating and, taken together, provide both the newcomer and the old-hand much to ponder’ – Fred D’Agostino, University of New England, Armidale `[A]ll that man is and all that raises him above animals he owes to his reason’ – Ludwig von Mises Contemporary Theories of Liberalism provides students with a comprehensive overview of the key tenets of liberalism developed through Hobbes, Locke, Kant and Rawls to present day theories and debates. Central to recent debate has been the idea of public reason. The text introduces and explores seven dominant theories of public reason, namely, pluralism, Neo-Hobbesianism, pragmatism, deliberative democracy, political democracy, Rawlsian political liberalism and justificatory liberalism. As a proponent of justificatory liberalism, Gaus presents an accessible and critical analysis of all contempoary liberal political theory and powerfully illustrates the distinct and importsant contribution of justificatory liberalism. Contemporary Theories of Liberalism is essential reading for students and academics seeking a deeper understanding of liberal political theory today.
Legal ethics is often described as an oxymoron or contradiction in terms – lay people find the concept amusing and lawyers can find ethics impossible. The best lawyers are those who have come to grips with their own values and actively seek to improve their ethical practise. This book is designed to help law students and new lawyers understand and modify their own ethical priorities, not just because this knowledge makes it easier to practise law and earn an income, but because self-aware, ethical legal practice is right and feels better than anything else. Packed with case studies of ethical scandals and dilemmas from real life legal practice in Australia, each chapter delves into the most difficult issues lawyers face. From lawyers’ part in corporate fraud to the ethics of time-based billing, Parker and Evans expose the values that underlie current practice and set out the alternatives ethical lawyers might follow.
In Wealth and Justice, Arthur C. Brooks and Peter Wehner explore how America’s system of democratic capitalism both depends upon and cultivates an intricate social web of families, churches, and communities. Far from oppressing and depriving individuals, the free market system uniquely enables Americans to exercise vocation and experience the dignity of self-sufficiency, all while contributing to the common good. The fruits of this system include the alleviation of poverty, better health, and greater access to education than at any other time in human history-but also a more significant prosperity: the flourishing of the human soul.
Our parents often have a significant impact on the content of our beliefs, the values we hold, and the goals we pursue and becoming a parent can also have a similar impact on our lives. In Conceptions of Parenthood Michael Austin provides a rigorous and accessible philosophical analysis of the numerous and distinct conceptions of parenthood. Issues considered are the nature and justification of parental rights, the sources of parental obligations, the value of autonomy, and the moral obligations and tensions present within interpersonal relationships. Austin rejects the ‘proprietarian’, ‘best interests of the child’, and ‘biological’ conceptions of parenthood as failing to generate parental rights and obligations but considers more sympathetically the ‘custodial relationship’, ‘consent’, and ‘causal’ conceptions of parenthood and ultimately defends a ‘stewardship’ conception. Finally Austin explores the ‘stewardship’ view for practical and moral questions related to family life and social policy regarding the family, such as the education of children, the religious upbringing of children and state licensing of parents.
