The book is a critical review of accountability conducted under the authority of the United Nations Security Council, by the International Criminal Tribunal for Rwanda (ICTR), and the United Nations Transitional Administration in East Timor (UNTAET). It is centred on two case studies: the 1999 events in Rwanda, which constituted genocide, “the crime of crimes”, and the 1999 mayhem in East Timor. The books subjects to testing cross-examination tools to hold accountable persons with “the greatest responsibility” for serious international humanitarian law violations.A detailed expose is made of conspiracy to commit genocide. Comparison is also made whether joint criminal enterprise, and the forms of co-perpetration embodied in the Statute of the International Criminal Court provide effective alternatives in the case of atrocity crimes. A unique aspect of the book is its high-light of lessons learn in prosecution strategies; approaches in profiling perpetrators, particularly those with the highest level of responsibility for international humanitarian law violations; victor’s justice; superior responsibility; guilty pleas, and the effectiveness of the East Timor and the Indonesian Ad Hoc Human Rights Court processes. In the final analysis, the book offers a Matrix on Accountability.
“This book examines the role of philosophy and philosophers in bioethics. Academics often see bioethical studies as too practical while decision makers tend to see them as too theoretical. The purpose of this collection of new essays by an international group of distinguished scholars is to explore the troubled relationship between theory and practice in the ethical assessment of medicine, health care, and new medical and genetic technologies. The book is divided into six parts. In the first part, philosophers consider the definition of bioethics, the nature of applied ethics more generally, and the possibility of combining utilitarian and liberal strands of thinking in moral and political studies. In the second part, authors discuss the place and justification of principles in bioethics and the significance of medical and nursing experience in moral decision making. The third part addresses the complementary (or contradictory, as the case may be) principles of dignity, autonomy, precaution, and solidarity, and their use in theoretical and practical settings. In the fourth part, public health measures and experimental research are defended against traditional moral concerns. Part five scrutinizes parental responsibilities in bearing and rearing children, especially the reasons for and against human reproduction in individual cases. In part six, enhancements to human nature by various means are analyzed.”–Publisher’s description.
“Morality and religion have failed because they are based on duplicity and fantasy. We need something new….” With this startling statement, Richard Garner begins to define a system of behavior that will nurture our capabilities for love and language, for creation and cooperation. The satisfying personal and social strategy for living Garner proposes is “informed, compassionate amoralism.” To do without morality, he argues, is to reject the idea that there are intrinsic values, objective duties, and natural rights. Leaving illusions behind us and learning to listen to others and to ourselves may be what we need to lead us out of the darkness.Garner builds his case on a survey of moral definitions and arguments from ancient Greece forward. Beyond Morality revisits the tenets of Christianity and Eastern religious, providing readers with a meaningful overview of the history of moral thought.Quotations illuminate and illustrate the text, adding to the value of Beyond Morality as a textbook for ethics courses. Author note: Richard Garner is Professor of Philosophy at The Ohio State University.
