Gottfried Wilhelm Leibniz (1646-1716) was hailed by Bertrand Russell as ‘one of the supreme intellects of all time’. A towering figure in seventeenth-century philosophy, his complex thought has been championed and satirized in equal measure, most famously in Voltaire’s Candide. In this outstanding introduction to his philosophy, Nicholas Jolley introduces and assesses the whole of Leibniz’s philosophy. Beginning with an introduction to Leibniz’s life and work, he carefully introduces the core elements of Leibniz’s metaphysics: his theories of substance, identity and individuation; monads and space and time; and his important debate over the nature of space and time with Newton’s champion, Samuel Clarke. He then introduces Leibniz’s theories of mind, knowledge, and innate ideas, showing how Leibniz anticipated the distinction between conscious and unconscious states, before examining his theory of free will and the problem of evil. An important feature of the book is its introduction to Leibniz’s moral and political philosophy, an overlooked aspect of his work. The final chapter assesses legacy and the impact of his philosophy on philosophy as a whole, particularly on the work of Immanuel Kant. Throughout, Nicholas Jolley places Leibniz in relation to some of the other great philosophers, such as Descartes, Spinoza and Locke, and discusses Leibniz’s key works, such as the Monadology and Discourse on Metaphysics.
The concept of global justice makes visible how we citizens of affluent countries are potentially implicated in the horrors so many must endure in the so-called less developed countries.Distinct conceptions of global justice differ in their specific criteria of global justice. However, they agree that the touchstone is how well our global institutional order is doing, compared to its feasible alternatives, in regard to the fundamental human interests that matter from a moral point of view.We are responsible for global regimes such as the global trading system and the rules governing military interventions. These institutional arrangements affect human beings worldwide, for instance by shaping the options and incentives of governments and corporations. Alternative paths of globalization would have differed in how much violence, oppression, and extreme poverty they engender. And global institutional reforms could greatly enhance human rights fullfillment in the future.The importance of this global justice approach reaches well beyond philosophy. It helps ordinary citizens evaluate their options and their responsibility for global institutional factors, and it challenges social scientists to address the causes of poverty and hunger that act across borders.The present volume addresses four main topics regarding global justice: The normative grounds for claims regarding the global institutional order, the substantive normative principles for a legitimate global order, the roles of legal human rights standards, and some institutional arrangements that may make the present world order less unjust.All royalties from this book have been assigned to Oxfam.
Dagan’s book provides a dynamic and much needed account of the American law of restitution. The book reviews the existing doctrine, including the forthcoming (third) Restatement, using an ethical perspective to expose and examine critically the normative underpinnings of the core categories of restitution. Dagan also discusses some of the most controversial issues in the area, such as cohabitation, improper tax payments, and the role of constructive trusts as trumps in bankruptcy. He further tackles the recent restitution claims of slave laborers (or their descendants) against corporations that benefited from their enslavements, and of governmental bodies against injurious industries. Dagan argues that the concept of unjust enrichment is not an independent reason for restitution but, rather, serves as a loose framework, structuring the contextual application of commitments to autonomy, utility, and community in situations where either the cause of action or the measure of recovery is benefit-based. By integrating doctrinal and ethical analyses of restitution across the spectrum of restitution contexts, the author offers significant and provocative insights on existing law as well as possible reforms.
