One of the main original aims of philosophy was to give us guidance about how to live our lives. The ancient Greeks typically assumed that a life led in accordance with reason, a rational life, would also be the happiest or most fulfilling. Ingmar Persson’s book resumes this project, which has been largely neglected in contemporary philosophy. But his conclusions are very different; by exploring the irrationality of our attitudes to time, our identity, and our responsibility,Persson shows that the aim of living rationally conflicts not only with the aim of leading the most fulfilling life, but also with the moral aim of promoting the maximization and just distribution of fulfilment for all. Persson also argues that neither the aim of living rationally nor any of the fulfilmentaims can be rejected as less rational than any other. We thus face a dilemma of either having to enter a retreat of reason, insulated from everyday attitudes, or making reason retreat from its aspiration to be the sole controller of our attitudes. The Retreat of Reason explores three areas in which there is a conflict between the rational life and a life dedicated to maximization of fulfilment. Persson contends that living rationally requires us to give up, first, our temporal biases; secondly, our bias towards ourselves; and, thirdly, our responsibility to the extent that it involves the notion of desert and desert-entailing notions. But giving up these attitudes is so overwhelmingly hard that the effort to do so not only makesour own lives less fulfilling, but also obstructs our efficient pursuit of the moral aim of promoting a maximum of justly distributed fulfilment.Ingmar Persson brings back to philosophy the ambition of offering a broad vision of the human condition. The Retreat of Reason challenges and disturbs some of our most fundamental ideas about ourselves.
Moral Realism is a systematic defence of the idea that there are objective moral standards. Russ Shafer-Landau argues that there are moral principles that are true independently of what anyone, anywhere, happens to think of them. His central thesis, as well as the many novel supporting arguments used to defend it, will spark much controversy among those concerned with the foundations of ethics.
The contributions to Law and Art address the interaction between law, justice, the ethical and the aesthetic. The exercise of the legal role and the scholarly understanding of legal texts were classically defined as ars iuris – an art of law – which drew on the panoply of humanist disciplines, from philology to fine art. That tradition has fallen by the wayside, particularly in the wake of modernism. But, as this book demonstrates, a consideration of the relationship between law and art can still bring jurisprudence, and particularly critical jurisprudence, to life. In its attention to the inexpressible, art can contribute to the liberation of legal doctrine from its own self-imposed limits. It can inform the ethics of a legal theory that is concerned to address how theoretical abstractions and concrete oppressions overlook the singularity and spontaneity to which art attests. The contributors to this volume – and their engagement with the full range of ‘the arts’ – seek, therefore, to disturb and to supplement conventional accounts of justice: raising the difficulty, but also the promise, of that surplus which art reveals: of life over legal formalisation.
This book argues that the English law governing the end(ing) of life violates norms, such as the need for consistency and clarity, whose observance are vital for a properly functioning legal system. It will demonstrate that such difficulties stem from the law’s attempts to cleave to competing ethical injunctions concerning the value of human life and the individual’s proclaimed right to determine the ending of his or her life. In contrast to most contributions to the debate which tend to adopt more absolutist positions, this book concludes that a compromise position is defensible but that current compromise can be better articulated, thus restoring a measure of legal rationality.
