Can we criticize those who hold beliefs which are likely to be wrong? Or must we abandon notions of truth and objectivity and claim that certain beliefs are best for us while incompatible beliefs are best for others? Truth, Politics, Moralityaddresses this crucial issue and its implications for democracy by arguing that the notion of truth ought to be returned to the center of moral and political philosophy. Cheryl Misak persuasively makes a case for a certain kind of pragmatism in which a true belief is one that could not be improved by inquiry, nor defeated by experience or argument. Her compelling discussion makes sense of the idea that, despite conflict, pluralism, and the expression of difference, our moral and political beliefs aim at truth and can be subject to justified criticism.
Although an inchoate liberty theory of freedom of speech has deep roots in Supreme Court decisions and political history, it has been overshadowed in judicial decisions and scholarly commentary by the marketplace of ideas theory. In this book, Baker critiques the assumptions required by the marketplace of ideas theory and develops the liberty theory, showing its philosophical soundness, persuasiveness, and ability to protect free speech. He argues that First Amendment liberty rights (as well as Fourteenth Amendment equality rights) required by political or moral theory are central to the possibility of progressive change. Problem areas are examined, including the question of whether individual political and civil rights can in principle be distinguished from property rights, freedom of the press, and the use of public spaces for expressive purposes.
This volume analyzes concepts of nature and ‘the natural’ in discussions of biotechnology with four broad concerns in mind. First, it surveys the recent history of biotechnology debates and identifies characteristic reactions and approaches to new biotechnological developments that invoke appeals to nature. Second, it analyzes concepts of nature and ‘the natural’ as they are invoked and interpreted in five characteristic modes of discourse; viz., spirituality and religion, philosophy, science and medicine, law and economics, and aesthetics. Third, it identifies a core cluster of ontological, epistemological, moral, and aesthetic questions that arise in conversations about nature as normative. Fourth, it highlights the findings of each of the five chapters, identifies areas of contrast and commonality, and identifies areas for further research.
Distributed networks such as the Internet have altered the fundamental way a record is created, captured, accessed and managed over time. Law and ethics provide the major sources of regulatory controls over participants in such networks. This book analyses the interrelationship of recordkeeping, ethics and law in terms of existing regulatory models and their application to the Internet environment. It proposes an Internet model based on the notion of a legal and social relationship as a means of identifying the legal and ethical rights and obligations of recordkeeping participants in networked transactions. Medical, business and governmental relationships within communities of common interest based on trust illustrate the practical application of the model. As legal relationships have their basis in the law of obligations found in common and civil law systems, as well as archival science, the model has a broad-based application. The relationship model also provides a unique ethical and legal approach to property, access, privacy and evidence. Most importantly, the book provides an interdisciplinary approach to Internet regulation, which contributes to closer ties between those who research, teach and work in fields of ethics, law and archival science.
