Andrew Fiala examines the virtue of tolerance as it appears in several historical contexts: Socratic philosophy, Stoic philosophy, Pragmatism and Existentialism. The lesson derived is that tolerance is a virtue for what Fiala calls ‘tragic communities’. Such communities are developed when we come together across our differences, but they lack the robust sense of connection that we often seek with others – the complete sort of happiness that is offered by a more Utopian ideal of community. But rather than viewing this conclusion as a failure, Fiala maintains that tragic communities are the best communities possible for human beings who are aware of their own individuality and finitude. Indeed, they are typical of the sorts of communities created by philosophers engaged in dialogue with others.
What if there were no objective facts, no objective truth, no objectivity at all, only our belief in them? What if our consciousness itself is an unconscious invention, constructed out of logic and language? In this thought-provoking volume, Lynn Segal describes how the ideas of Heinz von Foerster compel us to explore the question, “Do we discover the world or do we invent it?” and suggests that we must first know how we think before we can claim knowledge of the world. The resulting philosophy, Constructivism, examines the limits of what we can know and argues that understanding these limits can lead us to be more responsible for our personal and collective behavior. After tracing the historical transition from religious belief to a belief in science, Segal examines objectivity from semantic, philosophical, and neurological perspectives. Segal shows that we can never achieve objectivity and that the scientific method ensures only a consensus among observers. Next, he details how language and logic unwittingly predetermine the very conclusions we derive when we try to know the world. Finally, he describes a computational model of cognition that does not depend on first positing the world to account for cognition and consciousness. While Constructivism may seem relevant only to those in the cognitive sciences, it is, in fact, highly relevant to everyone. Paradoxically, grasping the limits of our own under-standing can free us to live more creative and meaningful personal and professional lives.
China has the highest levels of copyright piracy and trademark counterfeiting in the world, even though it also provides the highest per capita volume of enforcement. In this original study of intellectual property rights (IPR) in relation to state capacity, Dimitrov analyzes this puzzle by offering the first systematic analysis of all IPR enforcement avenues in China, across all IPR subtypes. He shows that the extremely high volume of enforcement provided for copyrights and trademarks is unfortunately of a low quality, and as such serves only to perpetuate IPR violations. In the area of patents, however, he finds a low volume of high-quality enforcement. In light of these findings, the book develops a theory of state capacity that conceptualizes the Chinese state as simultaneously weak and strong. It also demonstrates that fully rationalized enforcement of domestic and foreign IPR is emerging unevenly and, somewhat counter-intuitively, chiefly in those IPR subtypes that are least subject to domestic or foreign pressure. The book draws on extensive fieldwork in China and five other countries, as well as on 10 unique IPR enforcement datasets that exploit previously unexplored sources, including case files of private investigation firms.
