Dagan’s book provides a dynamic and much needed account of the American law of restitution. The book reviews the existing doctrine, including the forthcoming (third) Restatement, using an ethical perspective to expose and examine critically the normative underpinnings of the core categories of restitution. Dagan also discusses some of the most controversial issues in the area, such as cohabitation, improper tax payments, and the role of constructive trusts as trumps in bankruptcy. He further tackles the recent restitution claims of slave laborers (or their descendants) against corporations that benefited from their enslavements, and of governmental bodies against injurious industries. Dagan argues that the concept of unjust enrichment is not an independent reason for restitution but, rather, serves as a loose framework, structuring the contextual application of commitments to autonomy, utility, and community in situations where either the cause of action or the measure of recovery is benefit-based. By integrating doctrinal and ethical analyses of restitution across the spectrum of restitution contexts, the author offers significant and provocative insights on existing law as well as possible reforms.
Mark Platts’ influential first book “Ways of Meaning” argued within the context of the philosophy of language that a realist’ account of moral thought was possible. “Moral Realities” defends the same possibility from the perspective of the philosophy of psychology. “Moral Realities” engages the classical moral philosophies of Hume, Mandeville and Nietzsche, and tackles the powerful arguments of the contemporary moral relativists. Platts uses an existing critique of philosophical notions of desire and value to present a descriptive metaphysics of morals–clarifying both what morality is and what it is not. He also employs a classification of desire that articulates a general theory of value and valuing which is distinguished by a cognitive approach given to certain kinds of moral valuing. The possibility of applying this approach to moral valuings is defended against the persuasive criticisms of both the Humean subjectivist and the contemporary moral relativist. This is a challenging book which illuminates many of the major issues of contemporary moral philosophy including: the practical nature of moral thought, free will and choice, morality and religious belief, and the pragmatics of moral discourse.
What makes an event count as an action? Typical answers appeal to the way in which the event was produced: e.g., perhaps an arm movement is an action when caused by mental states (in particular ways), but not when caused in other ways. Andrew Sneddon argues that this type of answer, which he calls “productionism”, is methodologically and substantially mistaken. In particular, productionist answers to this question tend to be either individualistic or foundationalist, or both, without explicit defence. Instead, Sneddon offers an externalist, anti-foundationalist account of what makes an event count as an action, which he calls neo-ascriptivism, after the work of H.L.A. Hart. Specifically, Sneddon argues that our practices of attributing moral responsibility to each other are at least partly constitutive of events as actions.
‘We know much more about the global politics of intellectual property than we do about national political contests over the ownership of knowledge. Haunss and Shadlen have identified this gap in the literature and have done a fine job of bringing together a set of essays that helps to fill this gap in our understanding of the multi-layered nature of intellectual property politics.’ Peter Drahos, Australian National University ‘This thought-provoking volume provides invaluable new insights and is a major contribution to the debate on the politics of intellectual property rights.’ Duncan Matthews, Queen Mary, University of London, UK This book offers empirical analyses of conflicts over the ownership, control, and use of knowledge and information in developed and developing countries. Sebastian Haunss and Kenneth C. Shadlen, along with a collection of eminent contributors, focus on how business organizations, farmers, social movements, legal communities, state officials, transnational enterprises, and international organizations shape IP policies in areas such as health, information-communication technologies, indigenous knowledge, genetic resources, and many others. The innovative and original chapters examine conflicts over the rules governing various dimensions of IP, including patents, copyrights, traditional knowledge, and biosafety regulations. Written from a political perspective, this book is a must-read for political scientists, sociologists and anthropologists who study IP and conflicts over property. It is also an essential read for stakeholders in institutions, NGOs and industry interested in knowledge governance and IP politics.
